Does eBay Collect Sales Tax on Domestic US Sales?
eBay collects and remits US state sales tax on domestic US sales in all states that have enacted Marketplace Facilitator laws. As of 2023, all US states with a sales tax have enacted Marketplace Facilitator legislation requiring platforms like eBay to collect and remit sales tax on behalf of sellers. Sellers do not collect, remit, or file sales tax for eBay transactions in any US state; eBay handles the entire state sales tax obligation.
Marketplace Facilitator laws designate online marketplaces as the party responsible for collecting and remitting sales tax on transactions that occur on their platform. South Dakota v. Wayfair (2018) was the US Supreme Court case that established states' authority to require out-of-state sellers and marketplace facilitators to collect sales tax. Following this ruling, all US states with sales tax enacted marketplace facilitator legislation.
US sellers on eBay do not need to obtain sales tax permits in any state for their eBay sales. eBay's obligation covers all states. Sellers who have multi-channel sales (selling on their own website, on Amazon, and on eBay) must separately handle sales tax for their own website sales and Amazon sales, but their eBay sales are fully covered by eBay's marketplace facilitator compliance.

Do International Sellers Listing on eBay.com Pay Any Additional Taxes?
